Fine notice: two weeks to object

An objection to a fine notice can be lodged within two weeks of service (Section 67 of the Administrative Offences Act). Before you say anything, it is worth inspecting the file: the measurement record, calibration certificate, operator training records and driver photo show whether the allegation holds up. The competent local court ultimately decides on the objection.

Driving bans, points and your licence

A driving ban lasts one to three months. If you have had no driving ban in the previous two years, you can choose when it starts within four months of the decision becoming final – important for commuters in the Emsland region. With eight points in the driving aptitude register, the licence is revoked. For alcohol: from 0.5 per mille you face a fine and a driving ban, from 1.1 per mille it is a criminal offence, and from 1.6 per mille the licensing authority usually requires a medical-psychological assessment (MPU).

After an accident: enforce your claims in full

If the accident was not your fault, the other party’s liability insurer must also pay your lawyer’s fees. I take care of repair or replacement costs, loss in value, hire car or loss of use, expert fees and compensation for pain and suffering – so that you are not reimbursed only in part.

Criminal offences in road traffic

Leaving the scene of an accident, drink-driving or endangering road traffic are no longer administrative offences but criminal offences. Besides a fine or imprisonment, you face withdrawal of your licence with a disqualification period of six months to five years. Even with minor parking bumps: anyone who leaves the scene without waiting a reasonable time or enabling the necessary details to be established commits an offence. Early defence is particularly important in these cases, as targeted measures can often shorten the disqualification period.

Frequently asked questions on traffic law

Is it worth objecting to every fine notice?

Not always. I review the file and tell you frankly whether an objection has a chance of success. With legal expenses insurance the cost risk is usually low.

My licence was seized – what now?

Do not say anything about the allegations and get in touch promptly. The provisional withdrawal of the licence can be appealed; often the aim is also to keep the disqualification period as short as possible.

Who pays the lawyer after an accident?

If the accident was not your fault, the other party’s liability insurer. If you share the blame, costs are reimbursed proportionally; legal expenses insurance often covers the rest.
